Q:We have exchanged contracts on a small plot which we now discover has, to our horror, a footpath crossing it. This did not show up on the solicitor&’s Local Search before purchase. What can we do ?

Recent case law suggests the local authority may be liable for giving incorrect information in response to local conveyancing enquiries. So if the footpath was registered and they failed to disclose this in their Local Search they may have to pay you compensation.
